“Personal Data”means any information which, either alone or in combination with otherinformation we hold about you, identifies you as an individual, including, forexample, your name, address, telephone number, email address, as well as anyother non-public information about you that is associated with or linked to anyof the foregoing data. “Anonymous Data” means data that is not associated withor linked to your Personal Data; Anonymous Data does not, by itself, permit theidentification of individual persons. We collect Personal Data and AnonymousData as described below.

1a. Information You Provide to Us

•       When you order oruse our Services, we collect Personal Data necessary to fulfill your order orcomplete our Services, which may include your first and last name, email andmailing address, phone number, and credit card information to facilitatepayment processing.

•       If you are aCustomer, when you create an account to log in to our Site, we may collectPersonal Data such as your first and last name, email and mailing address,phone number, profile picture, MLS number and credit card information tofacilitate payment processing.

•       If you provide usfeedback or contact us via email, we will collect your name and email address,as well as any other content included in the email, in order to send you areply.

•       When you postmessages or upload content within our Site, the information contained in yourposting will be stored on our servers and other users will be able to see it.

•       We also collectother types of Personal Data that you provide to us voluntarily, such as youroperating system and version, and other requested information if you contact usregarding support for the Services.

•       We may also collectPersonal Data at such other points in our Site that state that Personal Data isbeing collected.

Please notethat you can choose not to provide us with certain information, but this maylimit the features of the Site or Services that you are able to use.

Customers ofour Services may provide information about their employees, including employeefirst and last name, badge number, address, email address and billinginformation.

1d. Information Collected from Third Party Companies

We may receivePersonal and/or Anonymous Data about you from companies that assist MBS Highwayin providing the Services or companies that offer their products and/orservices on our Site. These third-party companies may supply us with yourPersonal Data. We may add this information to the information we have alreadycollected from you via our Services in order to provide and improve theServices.

2. Use of Your Personal Data

2a. General Use

Personal Datacollected by us is used either to respond to requests that you make, performthe Services, or to aid us in serving you better. We may use your Personal Datain the following ways:

•       To identify you as auser in our system

•       To send you SMSservice notifications, where you have consented to receive such messages,including: Morning Update notifications (alerts when your daily MBS Highwayvideo update is published and ready to view); Market Alerts (time-sensitivenotifications regarding significant mortgage-backed securities marketmovements); and Lock Alerts (notifications regarding rate-lock opportunities orrelevant changes to locking conditions). We use your mobile phone number todeliver these transactional service notifications. Where you have separatelyconsented to receive marketing communications, we may also use your mobilephone number to send promotional or marketing text messages related to MBSHighway products, services, webinars, events, training opportunities, demos, andplatform updates. You may opt out of marketing SMS communications at any timeas described below. We do not sell or share mobile phone numbers, SMS consentrecords, or SMS message data with third parties or affiliates for their ownmarketing or promotional purposes. We may share this information only withservice providers (e.g., carriers, messaging platforms) to operate our SMSprogram. We retain your mobile phone number for SMS notification purposes foras long as your account remains active or until you opt out of SMSnotifications, whichever comes first. Message frequency varies based on userpreferences and market activity and may include up to 8 messages per day.Message & data rates may apply. Reply STOP to opt out; HELP for help.

2b. MarketingSMS Communications

Where you provide consent, MBSHighway LLC may send promotional or marketing text messages regarding products,services, webinars, events, platform updates, demos, training opportunities,and related business communications. Consent to receive marketing text messagesis not a condition of purchase. Message frequency varies based on userpreferences and market activity and may include up to 8 messages per day.Message and data rates may apply. Reply STOP to opt out or HELP for assistance.Your mobile number and SMS consent information will not be sold or shared withthird parties or affiliates for their own marketing purposes.

2c. Creation of Anonymous Data

We may createAnonymous Data records from Personal Data by excluding information (such asyour name) that makes the data personally identifiable to you. We use thisAnonymous Data to analyze request and usage patterns so that we may enhance thecontent of our Services and improve Site navigation. MBS Highway reserves theright to use Anonymous Data for any purpose and disclose Anonymous Data tothird parties in its sole discretion.

3. Disclosure of Your Personal Data

3a. Third Party Service Providers

We may shareyour Personal Data with third-party service providers to: provide you with theServices that we offer you through our Site; to conduct quality assurancetesting; to facilitate creation of accounts; to provide technical support;and/or to provide other services to MBS Highway. Such third-party serviceproviders include payment processors, hosting service providers and technicalplatform providers (such as email, voice and text platforms). These third-partyservice providers are required not to use your Personal Data other than toprovide the services requested by MBS Highway.

3b. Affiliates and Acquisitions

We may sharesome or all of your Personal Data with our parent company, subsidiaries, jointventures, or other companies under common control with us (“Affiliates”), inwhich case we will require our Affiliates to honor this Privacy Policy. Ifanother company acquires our company, business, or our assets, by way of anytransaction including a merger or bankruptcy proceedings, that company willpossess the Personal Data collected by us and will assume the rights andobligations regarding your Personal Data as described in this Privacy Policy.

Regardless ofany choices you make regarding your Personal Data, MBS Highway may disclosePersonal Data if it believes in good faith that such disclosure is necessary(a) in connection with any legal investigation; (b) to comply with relevantlaws or to respond to subpoenas or warrants served on MBS Highway; (c) toprotect or defend the rights or property of MBS Highway or users of theServices; and/or (d) to investigate or assist in preventing any violation orpotential violation of the law, this Privacy Policy or Terms of Service.

This PrivacyPolicy addresses only our use and disclosure of information we collect fromand/or about you. We do not control the privacy policies of third parties, andyou are subject to the privacy policies of those third parties whereapplicable. The Site may contain links to other websites that are not owned orcontrolled by us. We have no control over, do not review and are notresponsible for the privacy policies of or content displayed on such otherwebsites. When you click on such a link, you will leave our Site and go toanother site. During this process, another entity may collect Personal Data orAnonymous Data from you. Please be aware that the terms of this Privacy Policydo not apply to these outside websites or content, or to any collection of dataafter you click on links to such outside websites.

5. Your Choices Regarding Your Personal Data

5a. Choices

We offer youchoices regarding the collection, use, and sharing of your Personal Data.

•       We will periodicallysend you free newsletters and emails that directly promote the use of our Siteor Services (including any services offered by our Affiliates). When youreceive newsletters or promotional communications from us, you may indicate apreference to stop receiving further communications from us and you will havethe opportunity to opt out by contacting us directly (please see contactinformation below).

•       Despite yourindicated email preferences, we may send you service-related communications,including notices of any updates to our Terms of Service or Privacy Policy.

•       Opt out of SMSnotifications. If you receive SMSservice notifications from MBS Highway, you may opt out at any time by replyingSTOP (or CANCEL, END, UNSUBSCRIBE, or QUIT) to any message you receive, byupdating your notification preferences in your MBS Highway account settings, bysending an email to support@mbshighway.com, or by calling 732-526-7900. Opt-outrequests are generally processed immediately, though it may take a short periodfor all systems to update. Opting out of SMS notifications does not affect youraccess to the Services. You may continue to receive service-relatedcommunications through other channels (such as email) in accordance with youraccount preferences. We do not sell or share mobile phone numbers, SMS consentrecords, or SMS message data with third parties or affiliates for their ownmarketing or promotional purposes. 5b. Changes to Personal Data

You may changeany of your Personal Data in your Account by editing your profile within youraccount or by contacting us directly. You may request deletion of your PersonalData by us, but please note that we may be required to keep this informationand not delete it (or to keep this information for a certain time, in whichcase we will comply with your deletion request only after we have fulfilledsuch requirements). When we delete any information, it will be deleted from theactive database, but may remain in our archives. We may retain your informationfor fraud or similar purposes. Please remember that if we have alreadydisclosed some of your Personal Data to third parties, we cannot access thatPersonal Data any longer and cannot force the deletion or modification of anysuch information by the parties to whom we have made those disclosures.

We also require youto enter a password to access your account information. Please do not discloseyour account password to unauthorized people. No method of transmission overthe Internet, or method of electronic data storage, is 100% secure. Therefore,while MBS Highway uses reasonable efforts to protect your Personal Data, MBSHighway cannot guarantee its absolute security.

7. Note to Users Outside of the United States

Your PersonalData may be processed in the country in which it was collected and in othercountries, including the United States, where laws regarding processing ofPersonal Data may be less stringent than the laws in your country.

8. A Note About Children

We do notintentionally gather Personal Data from users who are under the age of 18. If auser under the age of 18 submits Personal Data to MBS Highway and we learn thatthe Personal Data is the information of a user under the age of 18, we willattempt to delete the information as soon as possible. If a parent or guardianbecomes aware that his or her child has provided us with information withouttheir consent, he or she should contact us. We will delete such informationfrom our files as soon as reasonably possible.

10. Additional Provisions for California Residents

If you are aresident of California, the California Consumer Privacy Act (“CCPA”) (CivilCode § 1798.100) provides you with specific rights regarding your PersonalData. These include:

•       You can requestinformation about our collection and use of your Personal Data over the pasttwelve (12) months concerning: (i) the categories of Personal Data we collectedabout you, (ii) the business or commercial purpose for collecting your PersonalData, (iii) the categories of sources from which your Personal Data iscollected, and (iv) the categories of third parties with whom we share yourPersonal Data. You can request a list disclosing the categories of yourPersonal Data we have shared in connection with a business purpose.

•       You can request toreceive a copy of your Personal Data in a commonly used and machine-readableformat.

•       You can request thatwe delete your Personal Data, subject to certain exceptions.

Please note thatit may be necessary for us to verify your identity or authority to make therequest and confirm the Personal Data relates to you. Only you, or a personregistered with the California Secretary of State that you authorize to act onyour behalf, may make a verifiable consumer request related to your PersonalData. We will not discriminate against you for exercising any of your privacyrights under CCPA or applicable law.

During the pasttwelve (12) months, we collected the categories of Personal Data describedabove from California residents. We also disclosed such Personal Data to thirdparties for the purposes specified above during the past twelve (12) months. Wedo not sell your Personal Data.

11. Changes to this Privacy Policy

This PrivacyPolicy is subject to occasional revision, and if we make any material changesin the way we use your Personal Data, we will notify you by sending you anemail to the last email address you provided to us and/or by prominentlyposting notice of the changes on our Site. Any changes to this Privacy Policywill be effective upon the earlier of thirty (30) calendar days following ourdispatch of an email notice to you or thirty (30) calendar days following ourposting of notice of the changes on our Site. These changes will be effectiveimmediately for new users of our Service.

Please notethat at all times you are responsible for updating your Personal Data toprovide us with your most current email address.
